Carroll Shelby stands with the 2007 Ford Shelby GT Mustang

The children and estranged wife of legendary sports car designer Carroll Shelby are locked in an epic battle to determine who gets his body -- which has still not been buried a month after his death.

Carroll and Cleo Shelby were legally married when he died in Dallas May 10. They'd been estranged since he filed for divorce in 2010. Cleo is claiming since she was still married to Carroll, she has the right to control Shelby's body.

Money is certainly at the root of this.
It tears up many a family, post death of a loved one. Especially one who left behind a lot of money. Happened to my wife. Very sad that her siblings no longer talk.

My father and I had long talks about exactly what he wanted. He had a paper that made me executor. The estate was easy. I just split that down the middle with my only sibling.

Other families are not that lucky.

My cousins are already fighting about their share of what they never earned.

Since I have done financial planning most of my career, I have seen some amazing things in the last 22 years or so.

I have seen the 'worst' families come together as the result of the passing of a matriarch/partriarch.

I have seen the 'best' families do just the opposite.

I don't care how old you are (or aren't for that matter), if you are of adult age and don't even have a basic will, you are leaving these issues to chance.

It is as simple as that.
